By accessing or using AI Band Studio (aibandstudio.com), Band-a-Day (bandaday.com), or any associated mobile applications, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use our Services.

2. Description of Services

AI Band Studio and Band-a-Day provide:

AI-Generated Music: Access to music created using artificial intelligence technologies
Band Profiles: View fictional band information, member profiles, and promotional materials
Streaming Services: Listen to AI-generated music through our platform
Band-of-the-Day: Daily featured bands with exclusive content

3. User Accounts

To access certain features, you may need to create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Accept responsibility for all activities under your account

4. Content Ownership and Licensing

Important: All content on our Services, including but not limited to music, images, videos, band names, member profiles, and promotional materials, is owned by AI Band Studio or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to:

Stream and listen to music through our Services for personal, non-commercial use
View band profiles and content on our platforms

5. Prohibited Uses

You expressly agree NOT to:

Download, copy, or reproduce any music, images, or content from our Services
Resell, redistribute, or commercially exploit any content
Create derivative works based on our content without written permission
Use any automated systems (bots, scrapers, crawlers) to access our Services
Circumvent or disable any technological protection measures
Share, upload, or distribute our content on other platforms
Remove or alter any copyright, trademark, or attribution notices
Use our content for AI training or machine learning purposes without authorization
Misrepresent AI-generated bands or music as human-created
Claim ownership of any content from our Services

6. Streaming Limitations

Our streaming service operates under the following structure:

Guest Users: Limited to 2 songs per day
Free Registered Users: Limited to 10 songs per day
Subscribers: Unlimited streaming based on subscription tier

Streaming is for personal enjoyment only. Recording, capturing, or downloading streams is strictly prohibited.

7. Subscription and Payments

If you subscribe to premium features:

Subscription fees are billed in advance on a recurring basis
You authorize us to charge your payment method automatically
Subscriptions auto-renew unless cancelled before the renewal date
Refunds are provided in accordance with our refund policy
Prices may change with 30 days' notice

8. AI-Generated Content Disclosure

You acknowledge that:

All bands, members, and music on our Services are AI-generated and fictional
Band members are not real people; any resemblance to real persons is coincidental
Music is created using artificial intelligence and may not reflect human artistic intent
We make no claims about the originality or non-infringement of AI-generated content

9. User Conduct

You agree not to:

Violate any applicable laws or regulations
Infringe on the rights of others
Interfere with or disrupt our Services
Attempt to gain unauthorized access to our systems
Engage in any activity that could harm our reputation

10. Termination

We may suspend or terminate your access to our Services at any time, with or without cause, with or without notice. Upon termination:

Your license to use our Services immediately ends
You must cease all use of our content
We may delete your account and associated data
Provisions that by their nature should survive will continue in effect

11. Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI BAND STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.

13. Indemnification

You agree to indemnify and hold harmless AI Band Studio, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or your use of our Services.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website. Your continued use of our Services after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.
